ENJOINED FROM COMPETING IN CREDIT REPORTING INDUSTRY
Injunction Issued for Violation of Florida Uniform Trade Secrets Act
WEST PALM BEACH, Fla., June 15, 2007 - RMCR Inc. RunMyCreditReport.com, an Internet credit report and credit monitoring service provider, and its principal, Jeffrey Applebaum, are prohibited from participating in Internet marketing of credit reporting and monitoring products. Judge Robin Rosenberg, Circuit Court Judge for the 15th Judicial Circuit in and for Palm Beach County, issued an injunction for a violation of the Florida Uniform Trade Secrets Act this Wednesday. The court found that Applebaum and RMCR had misappropriated trade secret information belonging to Zaazoom Solutions, a leading affiliate Internet marketing company based in Phoenix, Ariz., in order to compete directly with Zaazoom. RMCR was under contract with Zaazoom as a wholesale supplier of credit reporting and credit monitoring products. Despite the contract, RMCR and Applebaum conspired with a key Zaazoom employee Tim Michael, formally with Azoogle, to steal trade secret and confidential information protected under the Florida Uniform Trade Secrets Act.
“Judge Rosenberg’s decision to terminate the defendant’s operations affords Zaazoom with the necessary relief that the Florida Uniform Trade Secrets Act is intended to provide,” said one of the Plaintiff’s attorneys, Don Hayden, a partner at Baker & McKenzie in Miami. RMCR is precluded from operating its own credit reporting and credit monitoring program until October 16, 2007, when the term of its contract with Zaazoom was scheduled to expire.
In addition to the injunction, Judge Rosenberg ordered that RMCR return all proprietary information and any copies thereof to Zaazoom within 10 days. The matter will proceed with regard to Zaazoom's money damages claims. Don Hayden of Baker & McKenzie in Miami and Gary Crandell from Denver, Colo., served as counsel for Zaazoom.
